Pierce Couch Attorneys File Supreme Court Amicus Brief
In June 2021, Pierce Couch attorneys Robert Lafferrandre and Jeffrey Hendrickson filed an amicus brief with the United States Supreme Court on behalf of the National Police Association (NPA), urging the Supreme Court to grant certiorari and review the Tenth Circuit’s decision in Bond v. City of Tahlequah. The case concerns both the appropriateness of relying on a citizen’s state-of-mind in determining whether the officer violated the Fourth Amendment, as well as the timing of the application of the Fourth Amendment in officer-citizen interactions. In the amicus brief, the NPA argues that the questions posed by the Bond case are subject to a circuit-split and that Tenth Circuit’s view–most recently applied in the Bond case–is incorrect. Along with the Petitioners and various other amici, the NPA asks the Supreme Court to grant certiorari and resolve the split in authority.
