Trial Win for PCH Partner, Carson Smith
Pierce Couch attorney, Carson Smith, recently obtained a verdict in favor of his client, Rosemary Barnett, at trial in Rogers County, OK. Ms. Barnett faced a counterclaim brought by a Defendant in the automobile negligence action. With the counterclaim, four “sides” were present and represented by separate counsel at trial: Plaintiff, Defendant, Counter-Plaintiff and Counter-Defendant. The incident arose at a three way stop intersection with four lanes of travel with various factors of sign placement, sightlines, road pitch and an embankment. Both litigants claimed the other failed to use ordinary care and were the sole cause of the accident, which occurred when Ms. Dyer, proceeding from a stop sign, entered the intersection to make a left turn and was struck during the turn by Ms. Barnett proceeding along the major county road. Both parties sustained injuries which were disputed in nature and extent at trial. Expert Mark Sole gave testimony on behalf of Barnett as to angular momentum and angles of turn and what that said about the vehicles’ positions on the roadway.
After deliberating for nearly five hours, the jury came back with a Green Verdict, essentially a double defense verdict. Defendant Dyer prevailed on Plaintiff’s claims against her and Counter-Defendant Barnett prevailed on Counter-Plaintiff Dyer’s claims against her.
